1. INTRODUCTION


These Terms and Conditions (“Terms”) govern access to and use of the website (www.tireneedsonwheels.ca) and the mobile tire services provided by Tire Needs On Wheels Ltd. within Edmonton and the surrounding areas. By booking or utilizing any of the services, users agree to be legally bound by these Terms.


It is strongly recommended that users read these Terms in full before accessing the website or engaging any services.




2. SCOPE OF SERVICES

Tire Needs On Wheels Ltd. is a mobile tire service provider offering on-site services including, but not limited to, seasonal tire swaps, flat tire repairs, tire mounting and balancing. Services are available within the city of Edmonton, Alberta, and its surrounding areas, subject to geographic limitations at the discretion of the company.


All services provided by Tire Needs On Wheels Ltd. are subject to appointment scheduling and availability, which may vary due to weather conditions, technician availability, equipment constraints, and other operational considerations. While we strive to provide prompt and reliable service, we do not guarantee same-day service or specific time windows unless expressly agreed upon in writing.


Clients are responsible for ensuring that their vehicle is parked in a safe, accessible, and legal location suitable for service. Tire Needs On Wheels Ltd. reserves the right to refuse or reschedule service if site conditions are deemed unsafe or non-compliant with applicable laws or regulations.


By booking a service, clients acknowledge and accept the inherent risks associated with tire and automotive work and agree to release Tire Needs On Wheels Ltd. from any liability arising from pre-existing vehicle issues, improper storage of tires, or third-party modifications. All services are provided "as is" without warranty unless otherwise specified in a separate agreement.


Tire Needs On Wheels Ltd. also reserves the right to modify service offerings, pricing, terms of service, or geographic coverage at any time without prior notice. Any disputes arising from the provision of services shall be governed by the laws of the Province of Alberta.




3. APPOINTMENT BOOKING AND PAYMENTS

Appointments with Tire Needs On Wheels Ltd. may be scheduled through our official website at www.tireneedsonwheels.ca or by contacting our customer support line at 1-888-280-9119. Appointment requests are considered tentative until formally confirmed via email. Clients are responsible for ensuring that the contact information provided is accurate and up-to-date to facilitate timely confirmations and communications.


We reserve the right to reschedule or cancel appointments due to unforeseen circumstances, including inclement weather, technician availability, or safety concerns. Clients will be notified of any changes as soon as reasonably possible.



Payment Policy


Accepted methods of payment include major credit cards (Visa, MasterCard, American Express), Google Pay, Apple Pay, debit cards, cash, and e-transfers. Unless otherwise agreed upon in writing, full payment is due immediately upon completion of the service.


All pricing is subject to applicable federal and provincial taxes, including GST, and may be exclusive of service fees, travel surcharges, or disposal/recycling charges. Any additional charges will be disclosed prior to the commencement of service whenever possible. A receipt will be provided upon completion of the service.


Failure to remit payment in full may result in late fees, collection actions, or suspension of future service eligibility. Tire Needs On Wheels Ltd. reserves the right to revise pricing or modify payment terms at its sole discretion without prior notice.




4. CANCELLATION AND NO-SHOW POLICY

Clients may cancel or reschedule their appointments without penalty provided that a minimum of four (4) hours' advance notice is given prior to the scheduled service time. This advance notice allows Tire Needs On Wheels Ltd. to manage technician availability efficiently and accommodate other service requests.


To cancel or reschedule an appointment, customers must use one of the following official channels:

  • Online: Visit www.tireneedsonwheels.ca/manage and follow the prompts to cancel your booking.

  • Phone: Call our customer support line at 1-888-280-9119 and provie the requested information.

Cancellations or changes made less than four (4) hours before the scheduled appointment time may be subject to a late cancellation fee or service call charge, at the discretion of Tire Needs On Wheels Ltd., especially if a technician has already been dispatched or preparatory work has been undertaken.


In the event of repeated cancellations or rescheduling by the same client, Tire Needs On Wheels Ltd. reserves the right to require a deposit for future appointments or to decline future service requests.




5. REFUNDS


Eligibility

  • If you cancel an appointment at least four (4) hours prior to the scheduled service time, and you have already made a payment or deposit, you may be eligible for a full refund of any pre-paid amount.

  • If our technicians are unable to complete the service due to reasons within our control (e.g., equipment failure, scheduling error), you are entitled to either a rescheduled appointment at no additional cost or a full refund of the affected service fee.


Partial Refunds

  • In cases where service is partially performed or materials have been used (e.g., a portion of a tire swap completed), Tire Needs On Wheels Ltd. may, at its discretion, provide a prorated refund corresponding to the unperformed part of the service.


Refund Process

  • All approved refunds will be processed through the original payment method.

  • Please allow up to seven (7) business days for the refund to appear on your account statement, depending on your bank or payment provider.


Exclusions

  • No refunds will be issued for cancellations or reschedule requests made less than four (4) hours prior to the scheduled service time, except in extraordinary circumstances determined at our sole discretion.

  • Refunds are not applicable if the customer fails to meet obligations outlined in these Terms (e.g., providing a safe and accessible workspace) causing the service to be incomplete or cancelled.

6. CUSTOMER OBLIGATIONS

By booking a service with Tire Needs On Wheels Ltd., customers agree to ensure that the designated service location provides a safe, accessible, and legally permissible environment for the performance of tire-related work. This includes, but is not limited to:

  1. A flat and stable surface suitable for vehicle lifting;

  2. Sufficient space around the vehicle for technicians to safely operate;

  3. Clear access to all wheels and tires;

  4. Compliance with all local bylaws, parking regulations, and property access rules.

Customers are solely responsible for obtaining any necessary permissions, consents, or legal rights required to perform service at a chosen location, including but not limited to commercial lots, private driveways, strata properties, or street parking areas. Tire Needs On Wheels Ltd. reserves the right to refuse service if, in the technician’s judgment, the site is unsafe, inaccessible, or otherwise unsuitable for service.


Customers explicitly agree to assume full financial responsibility for any fines, penalties, towing charges, or third-party claims arising from the improper or unauthorized use of a service location. Tire Needs On Wheels Ltd. disclaims all liability for consequences arising from non-compliance with these obligations.



Tire Installation Safety Standards


For optimal vehicle safety and handling performance, Tire Needs On Wheels Ltd. strongly recommends the installation of a minimum of two (2) matching tires per axle (i.e., front left and right, or rear left and right). Mixing brands, tread patterns, or tire conditions on the same axle may compromise vehicle control, traction, and braking efficiency.


Customers who choose to proceed with a tire installation that does not comply with this guideline do so at their own risk and acknowledge the potential hazards involved. Tire Needs On Wheels Ltd. shall not be held liable for any issues, damages, or accidents, including but not limited to tire failure or loss of vehicle control, resulting from the customer's decision to disregard this recommendation.




7. ACCURACY OF INFORMATION

Tire Needs On Wheels Ltd. strives to provide accurate, up-to-date, and helpful information regarding services, tire specifications, fitment, and product recommendations through its website, customer support channels, and service representatives. While we make every reasonable effort to ensure the accuracy of this information, final responsibility for selecting appropriate services or tires rests solely with the customer.


This includes, but is not limited to:

  1. Verifying correct tire size, load rating, and speed rating;

  2. Confirming compatibility with vehicle make, model, and year;

  3. Ensuring service or tire selection meets manufacturer and regulatory requirements.

Tire Needs On Wheels Ltd. shall not be held liable for any delays in service, failure to complete service, or additional costs incurred due to customer selection errors, incompatible tire choices, or reliance on incorrect or incomplete information.


Customers are encouraged to consult their vehicle owner’s manual or automotive manufacturer to confirm specifications before booking a service or purchasing tires. Any guidance provided by Tire Needs On Wheels Ltd. is for general informational purposes only and does not constitute a warranty or guarantee of fitment.




8. VECHICLE ACCESSIBILITY AND ADDTIONAL FEES

It is the customer’s responsibility to ensure that the vehicle is fully accessible and properly prepared at the time of the scheduled service. This includes, but is not limited to:

  1. Ensuring the vehicle is parked in a safe, legal, and accessible location;

  2. Providing the appropriate key or tool for removing any installed wheel locks;

  3. Unlocking the vehicle if necessary for access to spare tires, parts or necessary systems;

  4. Ensuring tires to be installed or serviced are present on-site and correctly matched.

Customers must also confirm that the correct tires have been selected for service, including appropriate size, type, and compatibility with their vehicle. Incomplete, incorrect, or missing tire sets may prevent technicians from completing the scheduled work.


For flat tire repair services, our technician will assess whether the damaged tire meets industry safety standards for repair. If the tire is deemed unrepairable due to sidewall damage, excessive tread wear, punctures outside of repairable zones, or other safety concerns, the customer will be advised accordingly. 


In such cases:

  • A service call fee will still apply for the diagnostic visit and attempted repair;

  • The customer may be offered alternative solutions such as tire replacement, if available, at an additional cost;

  • If no replacement can be completed during the visit, the service may need to be rescheduled, and further charges may apply.


Tire Needs On Wheels Ltd. reserves the right to apply additional fees, rescheduling charges, or service call fees if any of the above conditions are not met and the technician is unable to complete the scheduled service.


Delays, cancellations, or incomplete services due to vehicle inaccessibility, preparation deficiencies, incorrect tire selection, or unrepairable tires are the sole responsibility of the customer.




9. INCORRECT TIRE SELECTION

Tire Needs On Wheels Ltd. provides mobile tire services based on the information and selections provided by the customer at the time of booking. While we may offer general guidance upon request, the responsibility for selecting the correct tires—whether in terms of size, load and speed rating, type, or overall compatibility with the customer’s vehicle—rests solely with the customer.


This includes:

  1. Confirming the tire size matches the vehicle manufacturer’s specifications;

  2. Ensuring the tires are appropriate for the specific make, model, year, and trim level of the vehicle;

  3. Verifying compatibility with aftermarket modifications or specialty wheels;

  4. Considering seasonal requirements (e.g., winter tires) and local regulations.


Tire Needs On Wheels Ltd. shall not be held liable for issues arising from customer-selected tires that are incorrect, incompatible, or unsuitable for the vehicle. This includes but is not limited to:

  1. Inability to complete the scheduled service;

  2. Additional service fees resulting from incompatible installations;

  3. Unsafe vehicle handling or performance issues following installation;

  4. Voided manufacturer warranties or vehicle damage due to improper fitment.


If a technician determines that the customer-selected tires are not compatible with the vehicle at the time of service, the appointment may be rescheduled or canceled at the discretion of the company, and a service call fee or other applicable charges may apply.


We strongly recommend that customers consult their vehicle’s owner’s manual or speak with a certified automotive professional prior to purchasing or booking services involving tire installations.




10. FORCE MAJEURE

Tire Needs On Wheels Ltd. shall not be held liable for any failure to perform, delay in service, or inability to complete scheduled appointments due to circumstances beyond our reasonable control. These may include, but are not limited to:

  • Acts of nature (e.g., floods, fires, earthquakes, or storms);

  • Severe or hazardous weather conditions (e.g., extreme cold, snow, ice, or lightning);

  • Labor disruptions, strikes, or shortages;

  • Equipment failures outside our control;

  • Power outages, road closures, or traffic incidents;

  • Acts of government, regulatory restrictions, or emergency declarations;

  • Public health crises, pandemics, or civil disturbances.

In such events, Tire Needs On Wheels Ltd. reserves the right to cancel, delay, or reschedule services without liability, and we will make all reasonable efforts to communicate changes to customers in a timely manner.

Customers acknowledge and accept that force majeure events may impact our ability to perform services as planned, and agree that no refunds, penalties, or compensation shall be due for delays or disruptions arising from such conditions.

We remain committed to customer safety and satisfaction and will make reasonable efforts to reschedule services at the next available opportunity once conditions permit.




11. LIABILITY AND INDEMNIFICATION

Tire Needs On Wheels Ltd. maintains comprehensive general liability insurance that covers damages or losses arising directly from the performance of our mobile tire services, subject to the terms and limitations of our insurance policy. This coverage is in place to protect both our customers and our company in the event of accidents or service-related issues caused directly by our actions.


However, our liability is strictly limited and does not extend to:

  • Pre-existing damage to customer vehicles, wheels, tires, or mechanical systems;

  • Normal wear and tear or deterioration not related to the services provided;

  • Subsequent vehicle issues or malfunctions that are not a direct and immediate result of services rendered by Tire Needs On Wheels Ltd.;

  • Loss of use, downtime, lost income, or any indirect, incidental, or consequential damages;

  • Any damage arising from incorrect or unsafe tire selection made by the customer, despite recommendations or disclaimers provided.

By engaging with our services, customers agree that any claims must be supported by reasonable evidence linking the alleged issue directly to the specific service performed by Tire Needs On Wheels Ltd. within a reasonable timeframe following service completion.


Indemnification


By using our services, customers expressly agree to indemnify, defend, and hold harmless Tire Needs On Wheels Ltd., its directors, officers, employees, independent contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, fines, penalties, legal costs, and expenses (including reasonable attorney’s fees) arising out of or relating to:

  1. Customer negligence or misconduct;

  2. Breach of any obligations under these Terms and Conditions;

  3. Improper use of tires or equipment after service;

  4. Misrepresentation or failure to disclose relevant vehicle conditions or information;

  5. Use of unauthorized service locations or unsafe environments.

This indemnification obligation survives the completion of the services and remains enforceable to the full extent permitted by applicable law.




12. COSTS OF RECOVERY

Customers agree to remit full payment for all services rendered by Tire Needs On Wheels Ltd. in accordance with the terms set out at the time of booking or as otherwise agreed in writing. In the event that any portion of a service invoice remains unpaid beyond the due date, Tire Needs On Wheels Ltd. reserves the right to pursue collection of the outstanding balance through all available legal and administrative means.


Customers shall be responsible for all costs and expenses incurred by Tire Needs On Wheels Ltd. in the process of recovering unpaid balances. These may include, but are not limited to:

  • Collection agency fees;

  • Legal fees, including attorney or court costs;

  • Interest or late fees as permitted by law;

  • Administrative or processing charges related to collection efforts.


Tire Needs On Wheels Ltd. may, at its sole discretion, suspend or deny future services to customers with delinquent accounts until full payment has been received and cleared. Continued failure to pay may result in reporting to credit bureaus or legal action in accordance with applicable laws.


By engaging our services, customers acknowledge and accept this policy and agree to bear all reasonable and lawful costs associated with the enforcement of outstanding financial obligations.




13. INTELLECTUTUAL PROPERTY AND WEBSITE USAGE

All content, materials, and information presented on the official Tire Needs On Wheels Ltd. website, including but not limited to text, graphics, logos, icons, images, videos, service descriptions, downloadable documents, and website design elements, are the exclusive property of Tire Needs On Wheels Ltd. and/or its respective owners, and are protected by applicable copyright, trademark, and other intellectual property laws in Canada and internationally.


Except as expressly authorized in writing by Tire Needs On Wheels Ltd., you may not reproduce, copy, distribute, republish, download, display, post, transmit, or modify any part of the website or its content, in any form or by any means, for commercial or non-commercial purposes.


Customers and site visitors are granted a limited, non-transferable, and revocable license to access and view the website and its content solely for personal, non-commercial use, provided they do not remove or obscure any copyright, trademark, or proprietary notices.


Any misuse of the website or its materials in violation of this policy may result in termination of access, legal action, and/or reporting to appropriate enforcement authorities.




14. WEBSITE DISCLAIMER

The Tire Needs On Wheels Ltd. website, online booking system, and all associated digital services are provided on an “as is” and “as available” basis without any warranties, express or implied, regarding uninterrupted access, real-time availability, content accuracy, or error-free functionality. We do not guarantee that our website will always be secure, timely, or free of technical issues.


To the fullest extent permitted by law, Tire Needs On Wheels Ltd. disclaims all liability for any indirect, incidental, consequential, or punitive damages arising from your access to or use of the website, including:

  • Service interruptions or downtime;

  • Delays in booking or appointment confirmations;

  • Inaccurate or outdated website content;

  • Viruses, malware, or other harmful digital components.

This disclaimer applies solely to digital services and website usage. It does not override or limit any express warranties provided by Tire Needs On Wheels Ltd. related to tire installation, flat repair services, or products sold and installed, as outlined in our separate Service Warranty Policy and Tire Warranty Policy, which remain in full force and effect.




15. PRODUCT AND SERVICE WARRANTY

Services and products supplied by Tire Needs On Wheels Ltd. are covered under a separate Warranty Policy. Customers are encouraged to review the Warranty Policy to understand specific coverage, limitations, exclusions, and claims procedures.




16. PRIVACY AND DATA COLLECTION 

Tire Needs On Wheels Ltd. respects your privacy. We collect, store, and process customer information in compliance with applicable privacy laws within Alberta and Canada. Detailed handling of personal data, including your rights and protections, are outlined in our Privacy Policy.




17. HOURS OF OPERATION


Operational service hours are Monday to Friday from 9:00 AM to 5:00 PM and Saturdays from 10:00 AM to 4:00 PM. We are closed on Sundays and most statutory holidays. 


Please note that we do not offer emergency or roadside assistance, and we are under no obligation to provide services outside of our stated operating hours. Any service requests submitted after hours will be addressed on the following business day, based on availability, and may be subject to delays or refusal.




18. THIRD-PARTY WEBISTE, LINKS AND SOFTWARE

Our website may contain hyperlinks to external, third-party websites for convenience or informational purposes. Tire Needs On Wheels Ltd. expressly disclaims any responsibility or liability for the content, practices, privacy policies, or accuracy of such external sites.
